10 Year Congenital Warranty
Eligibility Requirements –
To be eligible for this warranty, all of the following conditions must be met in full. Failure to comply with any of these requirements will render the warranty null and void:
Initial Veterinary Examination:
1. The puppy must be examined by a licensed veterinarian within five (5) calendar days of the purchaser taking possession. This initial exam must include a complete physical evaluation and any diagnostic testing recommended by the veterinarian at the time of the visit.
Ongoing Veterinary Care:
2. The purchaser must provide regular, continuous veterinary care for the puppy, including all age-appropriate vaccinations, preventative treatments, and prompt medical attention for any illness or injury. Documentation of veterinary visits and treatments must be maintained and provided to Seller upon request in connection with any warranty claim.
Insurance Requirement:
3. The purchaser must secure coverage with any recognized pet insurance provider within the first thirty (30) calendar days after the adoption date. Proof of active insurance coverage during this period may be requested by Seller as part of the claims process.
Warranty Coverage –
- If the above eligibility requirements are met, Pupworld LLC (“Seller”) warrants to the original purchaser only the following protections against life-threatening congenital disorders. For purposes of this warranty, a congenital disorder is defined as a genetic or hereditary condition present at birth that is medically determined to significantly impair the puppy’s health or shorten its lifespan.
- the first three (3) years from the date of purchase, the puppy is diagnosed by a licensed veterinarian with a life-threatening congenital disorder, Seller will provide a replacement puppy of equal or lesser value to the original purchase at no cost to the purchaser.
- The purchaser may be required to return the original puppy to Seller, unless otherwise agreed in writing, or provide proof of humane euthanasia performed by a licensed veterinarian.
- Coverage Period: Years 4–10
If, during years four (4) through ten (10) from the date of purchase, the puppy is diagnosed with a life-threatening congenital disorder, Seller will, upon presentation of reasonable, documented veterinary expenses actually incurred for treatment of such condition, offer the purchaser one of the following remedies:- Option 1: Issue a credit equal to fifty percent (50%) of the original purchase price of the puppy (excluding shipping fees) to be applied toward the purchase of another puppy from Seller; or
- Option 2: Reimburse the purchaser for actual veterinary expenses incurred, up to a maximum of twenty-five percent (25%) of the original purchase price of the puppy.
Special Provisions for Sudden Death –
In the event of the sudden and unexpected death of the puppy at any point during the warranty coverage period, the purchaser must obtain, at their own expense, a necropsy report conducted by a licensed veterinarian or veterinary pathologist. The report must clearly state the cause of death and confirm whether it was the result of a life-threatening congenital disorder. Failure to provide such a report will result in denial of any warranty claim.
Exclusions and Limitations
This warranty does not cover:
- Any non-life-threatening condition, including but not limited to minor heart murmurs, patellar luxation, mild hip dysplasia, cherry eye, or other conditions that do not significantly shorten the puppy’s life expectancy.
2. Any illness, condition, or injury caused by neglect, abuse, accident, improper nutrition, environmental factors, or failure to provide regular veterinary care.
3.Any illness or condition that develops after the coverage period has expired.
4. Any costs related to diagnosis, treatment, surgery, medications, or other veterinary services unless otherwise specified in Section B.
5. Shipping, transportation, and delivery fees, which are excluded from all warranty remedies.
Claim Procedures
To make a claim under this warranty, the purchaser must:
Provide written notice to Seller within five (5) business days of the initial diagnosis of the life-threatening congenital disorder.
Submit veterinary medical records, diagnostic test results, and any other documentation reasonably requested by Seller.
Provide proof of compliance with all eligibility requirements set forth in Section A.
For sudden death claims, provide the necropsy report as required under Section C.
Seller reserves the right to have the puppy examined by a veterinarian of its choice before approving any claim.
Transferability
This warranty applies only to the original purchaser named on the purchase agreement and is not transferable to any subsequent owner, adopter, or recipient of the puppy.
Governing Law
This warranty shall be governed by and construed in accordance with the laws of the state in which the Seller is located. Any disputes arising under or in connection with this warranty shall be resolved in the courts of competent jurisdiction in that state.
